Abstract

The article examines issues of criminal liability for illicit arms trafficking. A comparative analysis of Articles 263 and 263-1 of the Criminal Code of Ukraine is conducted, identifying their common and distinctive features. Particular attention is paid to problematic aspects of the legal regulation of criminal liability for the unlawful handling of weapons under martial law. The authors propose legislative regulation of the procedures for the transfer and registration of captured weapons, as well as their explicit recognition as the subject matter of a criminal offense.
